General Power Of Attorney

Preliminary Matters

This is a general power of attorney is for use during periods when the Donor is physically incapacitated and the Donor provides authority for the attorney to do anything which he can lawfully do on the Donor’s behalf and where the Donor may not care to give their attorney the authority conferred under a lasting power and prefers to limit the scope of their authority to periods when the donor is physically incapacitated.

Mental Capacity & Understanding

Consider whether the Donor is mentally capable of understanding what is to be affected when executing the deed and in particular, whether the Donor is able to understand that:

  • the Attorney could assume (complete) control over the donor’s property and affairs; and
  • the Attorney could do (almost) anything which the donor could have done personally.

This is particularly important where the donor is a minor.
